Check the shift linkage on the trans, shift through the gears by hand, make sure it engages all of them.
Make sure the floor shifter is hooked up and adjusted correctly.

another possible problem i can hear the trans shift and the engine idle change when i shift but the transfer case does not spin but i know the t-case is good but it the trans used to have a vacuum t-case the new one is just mechanical could this be the culprit

So it's an AW4 out of a 1991 going into what year? It might be a mismatch with the TCU....the AW4 is electronically controlled.

No Transmission/Transfer case fluid

try putting something over the metal tube to stop it from sucking and see what happens. if anything theres always a central point for all things operated on vacuum, on my 86 cherokee theres a canister that has about 6 different vacuum lines running through it. Other than that I couldn't advise anything other than restricting/closing off that metal tube and seeing what effect it has.
